IH and this Website uses cookies, tracking technologies, and third-party analytics/advertising partners, with description of purposes (performance, personalization, marketing), all of which are subject to the Privacy Policy which is incorporated into these Terms and Conditions by this reference; by using the Website and Services, You are agreeing to the Privacy Policy including the data practices as set forth in that Policy.

IH is not engaged in rendering legal, financial, or other professional services or advice, and no information contained on this Website shall be deemed to be legal or other professional services or advice. To the extent You believe You need professional advice, We strongly advise obtaining independent professional advice from a professional qualified to render to You the appropriate services.

7. Limitation of Liability and Time Limit to Bring Claims

EXCEPT TO THE EXTENT REQUIRED UNDER APPLICABLE LAW (AND THEN ONLY TO THE MINIMUM EXTENT SO REQUIRED), IH SHALL NOT BE LIABLE FOR ANY DAMAGES (INCLUDING SPECIAL OR CONSEQUENTIAL DAMAGES) THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE THE CONTENT ON THIS WEBSITE – WHETHER OR NOT IH HAD KNOWLEDGE (EITHER EXPRESS OR IMPLIED) OF THE POSSIBILITY OF SUCH DAMAGES.‍

8. Specifications, Prices, Terms, Renderings and Other Information

The housing market is ever-changing and although We try to make certain that the information (including prices and terms) on this Website is accurate and up-to-date, at any time such information (especially prices and home specifications) are subject to change. Prices shown may include site-specific discounts and are based on information provided by the applicable seller (including the manufacturer). Prices may change based on market conditions, features ordered, and other factors that cannot be controlled. Photos, videos, renderings and/or drawings of homes may not be exact replications of the final product ordered and may show features, appliances, or furniture not included in the price set forth on this Website. Photos, videos, renderings and/or drawings of homes may also show a home in a location that is not available at this time or that has previously been sold. IH makes no guarantees regarding the location of any home (including the view from any home or any natural surrounding) prior to entering into a definitive agreement with IH. IH strongly suggests contacting IH to arrange for a site visit prior to purchasing a home. Each manufacturer reserves the right to make changes to its home designs and amenities and IH shall not be responsible for any such changes. Home descriptions and amenities are subject to change for a variety of factors, including at IH’s discretion. As such, amenities are not guaranteed and may change without notice. c. Dispute Resolution; Class Action Waiver; Jury Trial Waiver  

You and IH agree that all disputes will be resolved exclusively in court (not arbitration) subject to the venue and waiver provisions below.

YOU UNDERSTAND AND AGREE THAT THESE DISPUTE RESOLUTION TERMS APPLY TO ALL CLAIMS, DISAGREEMENTS, DISPUTES, OR CONTROVERSIES BETWEEN YOU AND IH, INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AGENTS, PARENTS, AFFILIATES, SUBSIDIARIES AND/OR RELATED COMPANIES, ARISING OUT OF OR RELATING TO YOUR USE OF OR ACCESS TO THE SERVICES.  

If a dispute should arise between You and IH, We want to provide You with a resolution that is efficient and cost effective. Before initiating an action, You and IH each agree to first provide the other a written notice (“Notice of Dispute”), which shall contain: (a) a written description of the problem and relevant documents and supporting information; and (b) a statement of the specific relief sought. A Notice of Dispute can be (1) mailed to Immersive Homes, 10455 Riverside Drive, Suite 110, Palm Beach Gardens, FL 33410, or (2) emailed to contact@immersivehomes.com. You and IH agree to make attempts to resolve the dispute prior to commencing any legal action and neither party shall file any lawsuit until a 30-day post-Notice of Dispute resolution period has expired. If an agreement cannot be reached within thirty (30) days of receipt of the Notice of Dispute, You or IH may commence a lawsuit in the court of applicable jurisdiction described and provided below.  

d. No Class Actions  

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND IH AGREE THAT ANY AND ALL DISPUTES BY, BETWEEN, OR INVOLVING YOU AND US (WHETHER BASED IN CONTRACT, STATUTE, TORT OR ANY OTHER THEORY) WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL PROCEEDING OR ACTION, OR REPRESENTATIVE ACTION OR PROCEEDING. ALL CLAIMS MUST BE BROUGHT SOLELY IN A PARTY’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, PRIVATE ATTORNEY GENERAL PROCEEDING OR ACTION, OR REPRESENTATIVE ACTION OR PROCEEDING.  

e. Waiver of Jury Trial  

YOU AND IH HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY AND ALL RIGHTS EACH OF THEM MAY HAVE (INCLUDING BUT NOT LIMITED TO, THEIR CONSTITUTIONAL OR STATUTORY RIGHT) TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING FOR ANY DISPUTE, INCLUDING BUT NOT LIMITED TO DISPUTES ARISING OUT OF, FROM, OR RELATING TO THESE TERMS OR THE RELATIONSHIP OF SUCH PARTIES.  

f. Governing Law and Venue for Actions  

These Terms and any action related thereto will be governed by the laws of the State of Florida without regard to its conflict of laws provisions. The exclusive jurisdiction and venue of any action, claim, or demand, relating to the Services will be in the state and federal courts located in the Palm Beach County, West Palm Beach, Florida and each of the parties hereto (IH, and You and Your transferees) waives any objection to jurisdiction and venue in such courts.  

g. Dispute Resolution Changes  

Notwithstanding the provisions describing changes to these Terms above, if IH changes this “Dispute Resolution” section, You may reject any such change by sending Us written notice by email to contact@immersivehomes.com, or by mail at Immersive Homes, 10455 Riverside Drive, Suite 110, Palm Beach Gardens, FL 33410 within thirty (30) days of the date such change became effective, as indicated in the “Last Updated” date above or, if applicable, in the date of Immersive Home’s email to You notifying You of such change. Upon receipt of such timely written notice rejection, such Dispute Resolution change will not be applicable to You.  

h. If any provision of these Terms and Conditions is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

i. These Terms and Conditions, plus the incorporated Privacy Policy, constitute the entire agreement between User and IH regarding website use, superseding prior understanding.
